Security Clearance and Bankruptcy

If you are in the military or working for a defense contractor and facing the prospect of filing for bankruptcy you will undoubtedly yourself, how will bankruptcy affect my security clearance?

As a Baltimore area bankruptcy lawyer this question will likely come up more than in the past as a result of base realignment that has brought more military related jobs to our area.

There is no clear cut answer to that question. Your security clearance may or may not be affected by a bankruptcy filing. There are several factors that need to be considered before a determination is made as to the impact of bankruptcy on a security clearance.

One of the key factors deals with the circumstances that led to the bankruptcy. Is the cause an unexpected event such as a serious illness or motor vehicle accident or prolonged financial irresponsibility. Other factors include such intangibles as your relationship with your chain of command. Are your bosses willing to vouch for you and write recommendations on your behalf? Thus a good rapport with your
superiors comes in handy here.

Ultimately, you have to make the decision on whether to file bankruptcy because sometimes the amount of debt leaves one no choice. Paradoxically, it is possible that a high amount of unpaid debt alone may impact your security clearance. Therefore, eliminating your debts through bankruptcy may make you less of a security risk.
